1. Standard Terms and Conditions
These are the standard terms and conditions for Website Design and Development and apply to all contracts and all work undertaken by Thrasker for its clients.
2. Supply of Materials
You must supply all materials and information required by us to complete the work in accordance with any agreed specification. Such materials may include, but are not limited to, photographs written copy, logos and other printed material. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount.
We are pleased to offer you the opportunity to make revisions to the design. However, we have the right ot limit the number of design proposals to a reasonable amount and may charge you for additional designs if you make a change to the original design specification. Our website development phase is flexible and allows certain variations to the original specification. However any major deviation from the specification will be charged at the rate of $50.0 per hour.
4. Project Delays and client Liability
Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content in photography for the work pages. During development there is a certain amount of feedback required in order to progress to subsequent phases. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.
5. Search Engine Optimization
We do not guarantee any specific position in search engine results for your website. We perform initial Search engine optimization during the development and offer services to enhance your search engine placement upon launch.
Thrasker has access to clients web accounts and all files related to web site. Programmer is not responsible for any punitive damage done to accounts, even if forewarned by the client. It is Thrasker's responsibility to not store any credentials in any database and to solely use the account for the intended purposes.
If the general purpose cannot be succeeded for whatever reason within a reasonable budget, the programmer will present the issues to the client. It is the client's statement that will allow either the programmer to continue or to redirect its initial objective to one that is either cheaper or more efficient. If by any reason there are complications that cannot come to an agreement between programmer and client any funds put into the project will be lost by client and the programmer is not obligated to refund any money that has been earned from the projects work.
8. Cancellations & Refunds
Client is not allowed for any reason to cancel / receive . a refund for their contract after payment and signature. Majority of the work is done throughout the duration and therefore our end of the contract is upheld.
9. Failure to payment
Failure to payment may result in a total site shut down. If site is shut down, client is still responsible for paying the remainder of the contract price and will be assessed a $100 shutdown fee per / website. This fee covers the labor to take down the site and to re-upload it.
